MIX & MATCH NEW ZEALAND POINTS PROGRAMME TERMS & CONDITIONS

  1. These Terms and Conditions relate to the Mix & Match New Zealand Points Programme (the Programme), operated by Mix & Match Travel NZ Limited (“Mix & Match”).

PROGRAMME PERIOD

  1. The Programme is open until Mix & Match provides notice to participants that the Programme is ending.

DEFINTIONS

  1. In these Terms and Conditions:

Account means an account containing a Member’s required registration details to create his/her own Mix & Match profile.

Discount means a discount coupon or code for products sold by Mix & Match provided to a Member as an outcome of a Promotion.

Member means a person who has a Mix & Match Account and is part of the Programme and collects Points for entry into a Draw(s).

Point(s) means a unit of Mix & Match points, which can be accumulated and used by a Member for purposes as determined by Mix & Match from time to time.

Prize means a prize awarded to a Member as an outcome of a Promotion.

Prize Provider means businesses other than Mix & Match whose goods or services are offered as Prizes under the Programme.

Programme means the Mix & Match New Zealand Points Programme; a marketing tool in which Points are collected by Members and may be used for purposes as determined by Mix & Match from time to time.

Programme Website means the website at www.mixandmatch.co.nz.

Promotion means a Promotion offered by Mix & Match where Points may be used to participate (with entry subject to the Terms and Conditions of the particular Promotion). Promotions may include but will not be limited to: Prize Draws, opportunities to purchase Discounts or Rewards using Points, and any other Promotion that may be offered at the sole discretion of Mix & Match from time to time.

Reward means a Reward provided to a Member as an outcome of a Promotion.

WHO CAN JOIN THE MIX & MATCH NEW ZEALAND POINTS PROGRAMME

  1. The Programme is open to New Zealand residents aged 18 years and over, who have a Mix & Match Account. However, participation in Promotions is not open to employees of the Mix & Match Travel or the House of Travel group of Companies, their advertising and promotional agencies, and in both cases their immediate families.
  2. Only individuals may be Programme Members and must agree to be bound by these Terms and Conditions.
  3. Please check the Programme Website regarding individual Points Promotions as additional specific restrictions for entry or participation may apply to some Points Promotions.
  4. The Programme is only for personal and consumer use and Points cannot be used for any business transaction or purpose.

HOW TO TAKE PART IN THE PROGRAMME

  1. Register or Login to Mix & Match to set up an Account. To do this, you will need to visit the Programme Website or download the Mix & Match Mobile Application (App). Please complete the registration process by entering your name, email address, a chosen password and all relevant fields.
  2. To participate in the Programme you will need to go to the Programme Website or App and register or login to start collecting Points.
  3. By using and enrolling into the Programme, Members agree that they have read and understood these Terms and Conditions and agree to comply with them.
  4. These Terms and Conditions should be read in conjunction with all instructions and guidelines for registration into the Programme as set out on the Programme Website and any supplemental Terms and Conditions relating to a particular Promotion. In the case of conflict between these Terms and Conditions and any supplemental Promotion Terms and Conditions, the later takes precedence.
  5. A Member can only have one Account in the Programme, which is accessible only by their nominated email address and password. Accounts created using automated devices or processes are not allowed and all such Accounts will be removed from the Programme. Mix & Match reserves the right, in its discretion (provided it acts reasonably), to remove a Member from the Programme where multiple Accounts are suspected, at which time any accrued Points balance will be null and void.
  6. A Member is responsible for ensuring that all times his/her information in their Account are accurate and up-to-date, and for the security of their password. Mix & Match is not responsible for any loss or liability caused by unauthorised access to an Account.
  7. Mix & Match makes no warranty that access to the Programme Website will be uninterrupted or error-free and will have no liability for any failure to access such website.

COLLECTING POINTS

  1. To collect Points , you may interact with the Mix & Match Website or Mobile App in any of the ways set out in the table below.
  2. The number of Points awarded varies depending on what action is undertaken. Each action can be undertaken a maximum number of times and a maximum number of points awarded for those actions, as set out in the table below. A Member can continue to interact with the Website more than the specified number of actions, but the Points awarded will not exceed what is set out in the table below.
  3. Alternatively, you may receive Points directly from Mix & Match, when Mix & Match in its sole discretion chooses from time to time to give away Points. Points may also be obtained through other methods as offered by Mix & Match from time to time.

* The points value for a flight Booking may change throughout the Programme at the discretion of Mix & Match. The minimum number of Points a Member will be awarded for booking a flight is 20 Points for a one way flight and 40 Points for a return flight.

  1. Responsibility is not accepted for Points lost, damaged or delayed as a result of any network, computer hardware or software failure of any kind. Please contact Mix & Match if you believe that Points have not been correctly credited to your account after 2 working days via help@mixandmatch.co.nz.
  2. Mix & Match reserves the right to change the number of Points awarded during the Programme.
  3. The sale, transfer, exchange or barter of Points is strictly prohibited. Points have no cash or other value and cannot be exchanged.
  4. Mix & Match may in its sole discretion from time to time adjust Members' Accounts upwards or downwards to reflect accounting errors, multiple accounts, or suspected fraud.
  5. Members may check their Points transaction history, including total Points, Points earned and Points entered into Draws at any time by logging in to their Mix & Match Account at www.mixandmatch.co.nz/login

SPENDING POINTS

  1. Please see the Website or the App for further details about methods offered to spend or utilise Points.
  2. Points will be subtracted from a Member's Account immediately upon a Member choosing to utilise them towards a Promotion.
  3. Once a Promotion has closed, Points entered cannot be reclaimed.
  4. Please refer to individual Promotion Terms and Conditions.
  5. Mix & Match is not responsible for and will not be liable for:
  • late, lost, delayed, misdirected, incomplete or unintelligible entries;
  • any injuries, losses, or damages of any kind caused by a Prize or Reward, or resulting from acceptance, possession, use or misuse of a Prize or Reward, or from participation in the Programme;
  • any printing or typographical errors in any materials associated with the Programme;
  • any problem with a Prize Provider or Reward Provider.
  1. Promotions will be subject to separate Terms and Conditions. Generally, Prizes, Discounts and Rewards are personal, non-transferable and cannot be sold to a third party.

COMMUNICATING WITH MEMBERS

  1. By registering as a Member and participating in the Programme, the Member agrees to provide up-to-date and accurate information to Mix & Match for the purposes of administering the Programme at all times.
  2. A Member agrees to allow Mix & Match to communicate with him/her via email with suitable offers, which may contain opportunities to participate in Promotions. Mix & Match may also send a Member emails confirming his/her Points balance. Mix & Match will always communicate under the terms of the Privacy Act 2020. Members preferring not to receive such offers can visit their Account information page and change their communication preferences to opt-out of receiving such communication from Mix & Match. ENDING MEMBERSHIP

  1. A Member can cancel his/her Account at any time by notifying customer service. For contact details please visit www.mixandmatch.co.nz/contact-us. Cancellation of an Account will be effective not later than thirty (30) days after a Member submits a cancellation request, during which period he/she may still obtain Points. Points will automatically be forfeited in accounts that are terminated or cancelled. Accounts and Point balances are not transferable upon such closure or otherwise by operation of law.

  2. Mix & Match reserves the right, in its discretion (provided it acts reasonably), to cancel a Member’s Account where the Member is in breach of these Terms and Conditions or is otherwise acting contrary to the spirit of the Programme. This includes, but is not limited to:
  • attempting to collect or redeem points in contravention with these Terms and Conditions;
  • attempting to have, or having, multiple accounts;
  • any fraudulent activity with respect to copying coupons, vouchers or purchasing or trading Points;
  • interfering with or manipulating the Programme or the Programme Website.
  1. Mix & Match will be the final arbiter in any decisions and these will be final and binding.

GENERAL

  1. Mix & Match reserves the right in its sole discretion to amend these Terms and Conditions and/or the operation of the Programme at any time upon reasonable notice. Any amendment will be effective upon posting the modified Terms and Conditions and/or modified Programme on the Programme Website and notifying Members either on the website home page or via email. In the event of an amendment to these Terms and Conditions and/or the operation of the Programme, a Member's non-cancellation or continued use of the Programme after 30 days will be deemed acceptance of the modified Terms and Conditions and/or Programme.
  2. A Member agrees to indemnify and hold Mix & Match, its affiliates, officers, and employees harmless from any claim, demand, expense, or damage, (including reasonable legal fees) relating to a Member's breach of these Terms and Conditions including the posting of any material on any of Mix & Match’s websites.
  3. Mix & Match reserves the right at any time, and from time to time, providing as much notice as reasonably possible, to:
  • amend or close a Promotion;
  • change or remove a Promotion; or
  • vary the number of Points required to participate in a Promotion.
  1. Except for any liability that cannot be excluded by law, including, but not limited to the New Zealand Consumer Guarantees Act 1993, Mix & Match expressly disclaims any responsibility and each Member agrees to release and hold Mix & Match (and its directors, employees, parent companies, agents, marketing partners and affiliates) not liable for any and all losses, damages, rights, claims and actions of any kind in connection with the Programme and/or a Prize or Reward or resulting from the delivery, acceptance and/or subsequent use of a Prize or Reward, including personal injury, death and property damage, and claims based on publicity rights, defamation or invasion of privacy.
  2. Without limiting the foregoing, Mix & Match assumes no responsibility for, and the Members release Mix & Match from, any loss, claim, damage or injury to person or property if, for any reason beyond Mix & Match’s reasonable control (e.g. due to computer viruses, network failure, bugs, tampering, unauthorised intervention, fraud, technical failures etc.) this Programme is not able to be conducted as planned and/or the Programme's administration, security, fairness or integrity are corrupted or affected. Further, in such circumstances, Mix & Match may invalidate any Codes or entries of any individual in any way involved in interfering or tampering with the conduct of the Programme or abusing the communication system upon which the Programme is being conducted.
  3. Any dispute under the Programme will be resolved by Mix & Match. In the event of error or omission on the part of Mix & Match, Mix & Match’s liability to the Member is limited to crediting disputed points or account balances to the Member’s Account.
  4. These Terms and Conditions are subject to the laws and jurisdiction of New Zealand. Mix & Match's failure to enforce strict performance of any provision of these Terms and Conditions will not constitute a waiver of Mix & Match’s right to subsequently enforce such provision or any other provision of these Terms and Conditions.
  5. Mix & Match reserves the right, in its sole discretion, to cancel or suspend the Programme should bugs, viruses, unauthorised human intervention, or any other cause beyond the control of Mix & Match (in its sole opinion) corrupt the administration, security, fairness, integrity or proper operation of the Programme or a Promotion, or for any other reason at the sole discretion of Mix & Match.
  6. Details from all Accounts will be collected and used for the purposes of conducting this Programme (which may include disclosure to third parties for the purpose of processing and conducting the Programme or a Promotion in connection with the Programme), Promotions, Reward, Discount, or Prize delivery and for publicity purposes surrounding this Programme. By entering the Programme you consent to the use of your information as described. You may access and/or change your data by logging into your Account and updating your registration details.
